The processing of personal data by Heras Mobile Fencing & Security always takes place on the basis of one of the lawful grounds for the processing of personal data within the meaning of Section 8 of the Personal Data Protection Act.

3.1 Human resources and personnel policy

This objective consists of inter alia the processing of personal data for the performance of an employment contract, on-call contract, secondment agreement, or another agreement on the basis of which work is executed for Heras Mobile Fencing & Security, including the processing of personal data to take the necessary steps prior to entering into a contract, including the execution of activities in the context of pre-employment and in-employment screening.

The objective of the processing of personal data further consists of the management and administrative records of recruitment and outplacement activities, deploy ability, leave of absence and other absences, reimbursements and benefits (including pensions), payments, tax-related matters, career and talent development, performance assessments, training, travel and reimbursement of expenses and communication with the member of staff.

3.1.1 Which personal data do we process in the context of the human resources and personnel policy?

Heras Mobile Fencing & Security processes this data for the purpose of inter alia name and address details, staff records statistics, data regarding job title and employment, CVs, references and assessments, passport details, including citizen service number, gender and date of birth, marital status details, spouses and children, user ID network, financial data for the payment of salary, contributions, benefits and expenses, data concerning (any) company mobile phone, company car and driving licence, passport photo, data regarding performance (for example promotion and assessments) and data regarding sickness absence, rehabilitation processes and incapacity for work percentages.

3.2 General policy and internal management

This objective consists of inter alia the processing of personal data for activities such as the recording of operational areas, the recordings of working hours, the management of (the costs of the use of) operating resources, the conducting of internal audits and other inspections, the optimisation and centralisation of IT operating resources, the implementation of measures in the context of company control and the drawing up and keeping up to date of member of staff files.

3.2.1 Which personal data do we process in the context of general policy and internal management?

For this objective Heras Mobile Fencing & Security processes inter alia contact details, staff records numbers, data regarding job title and employment, data regarding (any) company mobile phone and/or company car and data regarding the transactions that a member of staff (possibly) is authorised to execute, or the rights of access of members of staff to (IT) systems.

4. For how long does Heras Mobile Fencing & Security keep the personal data?

Heras Mobile Fencing & Security keeps the data for no longer than permitted by law and as is necessary for the purposes for which your data is processed. Your personal data will be removed after the end of the retention period, unless there is an obligation, on the basis of a statutory retention period, to keep the personal data for longer. In that case the personal data will be removed after the expiry of the last applicable retention period. Reference is made to the appendix to the Heras Mobile Fencing & Security Privacy Policy for the applicable retention periods.

Heras Mobile Fencing & Security will ensure after the end of the retention period that the personal data will be removed or put in an anonymous form in a careful and secured manner so that the personal data will no longer be traceable to the data subject. The personal data will no longer be processed by Heras Mobile Fencing & Security after the expiry of the retention period or destruction period.

5. How is the personal data secured?

Heras Mobile Fencing & Security takes suitable technical and organisational measures in conformity with the applicable security policy for the protection of your personal data against misuse and unlawful or unauthorised destruction, loss, change, disclosure, acquisition, or access.

Heras Mobile Fencing & Security has in the context of this security policy taken inter alia physical measures for access control by using inter alia access procedures, access passes, passwords and pin codes. Members of staff have the right to request an overview from Heras Mobile Fencing & Security of the personal data that is processed by Heras Mobile Fencing & Security. The right to access only concerns your own personal data.

Reference is made to article 5 of the Heras Mobile Fencing & Security Privacy Policy for the relevant procedures concerning requests for access, correction, addition, removal, or transfer of personal data.

In all cases requests for access or change of data will be dealt with on the basis of the applicable legislation and regulations. Insufficiently specified or excessive requests will not be dealt with.
